WE the People

President Trump announced at a recent rally that, if elected, he will call for an automatic death penalty if an illegal alien kills an American citizen.  And the crowd went wild.

It’s a great sound bite, but Trump isn’t going to gain or lose voters with a statement like that.  Everyone at the rally, or watching the live stream, are already voting for Trump, pretty much regardless of whatever he says.  As Trump said back in 2016, “I could stand in the middle of Fifth Avenue and shoot somebody, and I wouldn’t lose any voters.”

Yeah, it’s like that.

Likewise, I’m confident there are a lot of people who are adamantly opposed to Trump’s plan to implement an eye-for-an-eye policy when it comes to violent crimes committed by illegal aliens.  Those people, obviously, will be voting for Kamala.

Innocent? Really?

People who are against the death penalty generally support their belief by a couple arguments.  One being, “what if we accidentally execute an innocent person”.  I don’t know about you, but I’m OK with that risk. 

Personally, there is a close to zero chance that I’d be accused of killing someone when I didn’t actually do it.  I’m just not going to ever be in a situation where there would be a doubt.  There’s also a close to zero chance that I’d be accused of killing someone when I actually did do it, but that’s a different story.

The other argument anti-death-penalty folks use is that the State shouldn’t be deciding if someone lives or dies.

The problem with that is that the State isn’t making that decision, the perpetrator is.  The State simply defines what the punishment is for any particular crime.  The person committing the crime, having free will, is responsible for their decision of whether to commit the crime in the first place, knowing full well what the penalty will be for doing so. 

I can already hear someone pointing out that perhaps one or more violent illegal aliens won’t know that the punishment for killing someone would be an automatic death penalty.

Ignorance of the penalty is no excuse.

To that I say, if ignorance of the law is no excuse, then ignorance of the punishment shouldn’t be an excuse either.

So yeah, I’d be 100% in favor of an automatic death penalty if an illegal alien kills an American Citizen.  I don’t care if they accidentally kill someone.  Without them being in the country illegally, the person they killed would likely still be alive.   I’d also be on board with limiting the appeals process so they can’t draw their case out for years.

The important thing here is the term, “American Citizen.” 

If a violent illegal alien killed an American Citizen, the automatic death penalty would apply.  But if that same illegal alien, or anyone really, killed someone not here legally, the penalty may be much less.

Now, this may sound like a double standard, which it is.  But it’s not all that different than having tougher penalties for “hate crimes”.  If someone kills me, a white guy, the penalty will be less than if they kill a black guy or a Jew.  Or a black guy who happens to be a Jew.  Or a black Jewish guy who happens to believe he’s a woman.  And, since there’s no way killing an old white guy would be considered a hate crime, that means that all those other lives are considered more valuable than mine. 

So, let’s not talk about creating a subclass of people.  Because that ship sailed a few years ago.

Self Deportation

To get things back to some semblance of the way things were, we’ll need to send tens of millions of Kamala’s border crossers back home.  But that will take a lot of time and money.  Besides, the Alien Enemies Act of 1798 requires that before we can deport anyone, they must have their day in court. 

And that means that we’d have to process each and every one of the 20 million or so illegals Kamala and Biden let into our country before we can send them home.  That could take forever.  Or Congress passes a law that overrides the Alien Enemies Act.  Which could also take forever.

So, what we need is a way to get them to deport themselves.

It’s our Constitution dummy.

Here’s an idea I’ve been kicking around for a while.  The idea is that the United States Constitution should only apply to citizens of the United States.  I’ll even expand that to people who have applied for citizenship going through the normal channels.  Once someone properly applies for citizenship, they should enjoy the full protection of the Constitution of the United States of America.

Illegal aliens…not so much.

And let’s add to the protected list anyone in the country on a current and valid visa.  Valid visa holders should enjoy the full protection of the Constitution.  But that protection evaporates the second their visa expires.

So, we end up with two groups.  The protected group and the unprotected group.  The only difference being if they’re here in the country legally.  Then we could stop with all this “illegal immigrant” or “undocumented” bullshit and just call them “unprotected”.

Undocumented/Unprotected…potato/potahto.

The unprotected would essentially have no rights.  OK.  Maybe we’d give them one guarantee.  We would promise to try our best not to kill them while they were being rounded up and sent back to where they came from.  But, if they resist in any way, then all bets are off.

They would not be allowed to protest anything.  Not in our country.  Nor would they be allowed to own or carry weapons or be protected against search, seizure and arrest.  And there would be no bail.  Period. 

Next, we give the border patrol the ability to arrest and detain illegal border crossers on the spot.  There’s no sense in doing catch-and-release and then having to track them down again later.  The closer to the border we catch them, the less it will cost to send them back to where they came from.

It’s all fine and dandy to have an automatic death penalty, but I think the goal should be to round them up get them out of the country before they kill anyone.

If an illegal alien is caught, and they broke no other laws, they would be immediately arrested, processed and deported.  Do not pass Go, do not collect a debit card or free cell phone, healthcare, room and board, or taxpayer-paid “gender affirmation surgery”.

Hard Time

But, if they had broken any other law, even something as trivial as jaywalking, then they would be incarcerated.  And I’m not talking about one of those places where prisoners have rights that are protected by the Constitution.  Because the Constitution wouldn’t apply.  I’m talking about a prison specifically for illegal aliens.  A place where everyone does hard time.  The kind of place where nobody would ever want to be.

I’ll even go a step further.  Before we send anyone back home, they’d need to spend at least a few weeks in one of those prisons.  That should be enough incentive for them not to come back.

And another thing, nobody should be able to illegally enter our country and then claim asylum when they get caught.  The only way asylum should be allowed to be claimed is if the person requesting asylum entered the country legally.  Period. 

I don’t care what your story is, what coconut tree you fell out of or what shithole country you’re coming from, don’t break one of our laws the second you step on to U.S. soil and then expect sympathy.  Why should we believe your situation is more dire or immediate than the people who have been patiently waiting, sometimes years, for their turn?  If you want asylum, get in line like you’re supposed to.

The Answer is Simple

This umbrella application of the Constitution we have now causes problems, because people come here illegally, and then use our Constitution against us.

So, let’s take that loophole away and make it so the Constitution only applies to people in this country legally.  If we were to do that, then being an illegal alien here in the United States would become a very unpleasant experience.

It would take an act of Congress before any mass deportations can take place.  So, we can either negate the Alien Enemies Act, which would still require a ton of work on our part, or we change things, so the Constitution only applies to someone here legally.

I’d bet cash money that once word got out that entering the United States illegally comes with real consequences, we’d see an immediate decrease in illegal border crossings.  And maybe, just maybe, Kamala’s illegal aliens that are already here would start to think that it would be a better idea for them to just pack up their shit and take themselves back home.
